These Terms of Service ("Terms") govern your use of laaquaguardfl.com (the "Site") and the pool maintenance, equipment repair, and related services (the "Services") provided by LA AquaGuard FL LLC, a Florida limited liability company ("LA AquaGuard FL," "we," "us," or "our"). By accessing the Site, requesting a quote, or engaging us for Services, you ("you," "Customer," or "Client") agree to these Terms.

Read this carefully. These Terms include important provisions about scheduling, payment, warranties, limitations of liability, and dispute resolution. By using our Services, you agree to all of them.

01Acceptance of Terms

By accessing the Site or engaging our Services, you confirm that you (a) are at least 18 years old; (b) have the authority to enter into these Terms; (c) have the legal right to authorize service at the address provided; and (d) agree to be bound by these Terms and our Privacy Policy.

02Description of Services

LA AquaGuard FL provides residential and small commercial pool services in Central Florida, including:

Services are provided in Orange, Osceola, Polk, and Seminole counties, Florida. Availability for any specific request is subject to scheduling capacity and our service area at the time of request.

06Cancellation

One-time appointments

You may cancel or reschedule a one-time appointment at no charge by giving at least 24 hours' notice. Cancellations with less than 24 hours' notice may incur a fee of up to $50 to cover scheduling costs.

Recurring maintenance subscriptions

You may cancel a recurring maintenance plan at any time with seven (7) days' written notice (email is sufficient). Cancellation takes effect at the end of the current billing cycle. No partial refunds for unused days within a billed period are issued, but you will continue to receive scheduled services through the end of that period. See our Refund Policy for additional detail.

EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS, THE SERVICES AND SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION OF THE SITE.

09Limitation of Liability

To the maximum extent permitted by applicable law, LA AquaGuard FL LLC, its members, managers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, loss of use, property damage beyond the scope of our direct work, or damages arising from delays, weather, or third-party equipment failures — even if we have been advised of the possibility of such damages.

In no event shall our aggregate liability for any claim arising out of or relating to these Terms or the Services exceed the amount you paid us for the specific service giving rise to the claim during the three (3) months immediately preceding the event.

10Indemnification

You agree to indemnify, defend, and hold harmless LA AquaGuard FL LLC and its members, managers, employees, contractors, and affiliates from and against any third-party claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from (a) your breach of these Terms; (b) your violation of any law or third-party right; or (c) misuse of the Services or the Site.

11Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-laws principles. The exclusive venue for any dispute that proceeds to court (subject to Section 12) shall be the state or federal courts located in Osceola County, Florida, and you and we consent to personal jurisdiction in those courts.

12Dispute Resolution

Step 1: Informal resolution

Before filing any formal claim, the parties agree to attempt to resolve the dispute by good-faith negotiation. You can reach us at info@laaquaguardfl.com. Most issues can be resolved this way within a few days.

Step 2: Small-claims option

If the dispute cannot be resolved informally and falls within the jurisdictional limits of Florida small-claims court, either party may file there.

Class-action waiver

To the extent permitted by law, you and LA AquaGuard FL agree that any dispute will be resolved on an individual basis, not as a plaintiff or class member in any purported class, collective, or representative action.

13Changes to Terms

We may update these Terms from time to time. The most current version will always be posted on this page with an updated "Last updated" date. For material changes affecting existing customers, we will provide reasonable advance notice (typically by email). Continued use of the Services after changes take effect constitutes acceptance.
